Say that you raised a child that is not biologically yours.  Your spouse had the child before the marriage, and you care very much for the child.  What happens with custody during a divorce in Texas?

Unless you have adopted the child, Texas will not consider this divorce as one involving children.  The Texas family code does not consider a step-parent as a person with all legal rights to the step-child.

So, if you have a step-child that you care deeply for and wish to have parental rights of regardless of the status of your marriage, you should consider a formal adoption of the child.
